What is a TOS?

A TOS stands for "Terms Of Service". This is a legal agreement between you (the commissioner) and me (the artist). These are rules for commissioning me, and using my art. Please read this before commissioning me. All of this is pretty standard stuff, but if you have any questions please feel free to message me!

By commissioning me, it will be assumed that you have read and agreed to my TOS!

Breaking the TOS

If there is a failure and/or breach to follow my TOS then you WILL be sent a message on the platform in which the commission was ordered telling you what is wrong, followed by a request to fix the issue. If there have been no changes made within 48 hours of my notice being sent, there will be follow up. There will be a ban from all forms of purchase from me, including but not limited to; future ordering of a commission, future sales and all forms of contact. You will essentially be black listed.

Payment

All prices of my work are listed in USD, and are considered accurate. Prices are subject to change with additions, depending on complexity of your piece. You, the commissioner, will receive a price breakdown via private messages. Payment needs to be paid in USD, and if you send in a different currency, you will be refunded and be asked to switch to USD. 

 

  • REFUNDS: I do NOT give refunds past a certain point. I will work on a piece until you are happy with it, but refunds will not be made possible after the sketch. Therefore it will ONLY be issued before I begin or if I’m at the sketch phase, but please keep in mind a fee will be deducted for the work I've already done.

  • When price is agreed upon by both parties, I will invoice you via PayPal with the email provided. Invoices are in USD, and will include a price breakdown, a small message from me and another link back to my TOS. ​

  • If your piece is complex, additional fees will be added but this will always be relayed to you prior to invoicing. I don't sneak fees into my prices and I always include a price breakdown to help you understand what costs what, but please feel free to ask me any questions at any time. 

Process and WIP's 

WIP: Work In Progress. I love to communicate with my commissioners, you spent your money after all. I try to be as transparent and through as I possibly can be while I work. I want you to see the process and enjoy it just like I am enjoying it! 

  • First and foremost we'll discuss the idea, I'll ask you for any reference photos that I may need or any clarification to ensure everything is as clear and understood as possible. I want to ensure I do your character  correctly and bring your idea to life to the best of my ability. Once we have discussed the idea, it is at this point that you will get a price breakdown and an invoice.

  • I send WIP's at every stage of my work, which you as the commissioner will need to approve. This is because it's very hard to go back and change something once I've moved onto the next stage of the art, and I encourage you to please tell me what you may want fixed or adjusted. I promise I won't get mad! I want you happy first and foremost with the piece! With that being said, if you have approved a stage and I have moved onto the next but you want me to go back and change something; there may be an extra fee depending on how complex the change is. Be sure you like what I send when you approve! 

  • I reserve the rights to my art, please understand that WIP's, sketches, linework, any process of the creative process up to and including the final product may be posted to social media for promotional purposes. I will NEVER share your reference photos you send me such as reference sheet or photos. I will just post my art. If you do not want your progress photos posted, or the final piece posted please inform me when first ordering the commission. There will be an extra fee for private commissions where I can't post. 

General Info

  • If commissioning an OC (original character): I will only work off of a reference sheet or an unshaded fullbody piece. It must be a legitimate and easily legible ref sheet or unshaded piece. The only exception to this rule is if you are commissioning me for a ref sheet. If you do not have either of these (example: commissioning art of your character in a game); an additional fee will be added.

  • If commissioning a drawing of yourself: Please provide reference pictures of your face, and a written message of your eye colour as this can sometimes be hard to see.

 

  • If there is something in the sketch you really don’t like or isn’t right.. PLEASE TELL ME. Don't tell me after, when I'm already lining or colouring. Changes wont be made at that point.

 

  • You may not alter or change my work in any way, shape or form. That includes not removing my watermark.

Commissioner Rights

  • You, the commissioner, are purchasing my time, effort and skills. You are commissioning me, an independent artist, to fulfil a service for you and create a piece of art. You are NOT purchasing a physical good (unless discussed and stated otherwise), you are purchasing a digital art piece. Upon delivery of final work, you are granted a non-commercial license to upload the art online and display it. You may not claim the piece as your own work, and credit as the artist must be credited back to me. You may not resell my work for commercial use, nor claim the art as your own. You may not remove, distort or hide my watermark under any circumstance, I ensure to put it in a spot out of the main focus of the piece. The commissioner may use the art as display pictures, stream banners, icons, emotes, etc. Any private information shared such as (e-mail, birth dates, contact information or any other information deemed personal) will not be displayed to anyone.

  • If you want commercial license to a piece (such as merch) please inform me at the time of commissioning me so I can make notes of who is purchasing a commercial license to profit off my work. There is a fee for commercially licensed work. 

  • In the event of a cancellation, resulting in a refund, all ownership rights granted to you will revert back to me. I reserve the right to sell the sketch to someone else and change the details to better suit their character instead.

Artist Rights

I retain ownership of the art I produce, which means I may post it on my own profile, sites, and use it as promotion. Please understand I am human, do not mistreat me. I reserve the right to deny or cancel a piece (and provide you with a refund) should the relationship between us become uncomfortable, toxic, or abusive. I also reserve the right to not engaging in the behaviour. I reserve the right to use any product(s) made at my own discretion, giving credit to the commissioner as character owner. I retain full rights to the art prior to the finalization, you may not post or share WIP’s. Please do not share my WIP's that I privately send to you with others or on social media. Upon finalization and completion, the commissioner will gain a non-commercial license to post art for their own sites, profiles, etc.

Will Draw/Won't Draw

WILL DRAW

  • SFW, including but not limited to affectionate scenarios (kissing, cuddling, hugging, etc)

 

  • NSFW (Regular/Vanilla sex, BDSM, foreplay, etc)

 

  • Any species, not limited to; Humans, Neko’s, Humanoid, Monster (including demons) and Anthropomorphic.

 

  • Any gender

 

  • Any sexuality/romantic orientation

 

  • Some fetishes (Ex: BDSM, Dom/sub, Oral, Bondage, Size play, ask if unsure)

 

  • Pregnancy (NOT FETISHIZED)

 

  • Children/Teenagers/Young Adults/Adults (SFW ONLY)

  • Masturbation


 

WILL NOT DRAW

  • Certain fetishes (including but not limited to; Vore, paw/feet, urination, scat, pedophilia, inflation of any body part. Please ask if unsure.)

 

  • Minors in any form of NSFW scenery or content

 

  • Harassment/Bullying

 

  • Offensive content (EX:Racism, homophobic behaviour, bullying, rape, etc)

 

  • My characters with yours sexually
